Real Estate
The real estate market in Western North Carolina is particularly active, making it a great market for buyers, sellers, and real estate professionals. However, making decisions without the right advisors could cost buyers and sellers significantly.
Our firm values a pleasant process, where we can make sure that buyers, sellers, and investors may achieve their goals as quickly and easily as possible, without compromising on the details.
Real Estate Closings & Refinances
We want the closing process to be as simple and stress-free as possible for you, whether you're buying, selling, or refinancing. Our firm handles a wide array of residential and commercial real estate closings throughout the Western North Carolina area.
For Buyers
Whether you’re a first-time homebuyer or a seasoned professional, our goal is to provide you with detailed guidance throughout your property-buying journey. In preparation for all of our closings, we will complete a thorough title examination and procure title insurance to be sure that your new property is free of any encumbrances and will be able to seamlessly pass from the current owners to you. We pride ourselves on working efficiently with a wide array of lenders, brokers, and other law firms in the area. We want you to feel confident and informed every step of the way, from signing your contract to wiring your final payment.
For Sellers
We’re committed to making sure you don't get any unpleasant surprises during the closing process. When representing clients in the sale of their property, we will prepare all necessary documents (which includes your Deed, settlement statement, affidavits, and disbursement instructions), facilitate your signing, coordinate with any property management associations, and order any loan or mortgage payoffs that may be required at closing.
For Real Estate Agents

Title Work
In any real estate transaction, all previous transfers of title must be reviewed before the property is sold. The in-depth title searches our firm performs reassures both the buyer and the seller that title to the property is free and clear of any hurdles that could hinder the transaction. Should we uncover any title issues, such as liens, past foreclosures, easements, restrictions, HOA disputes, encroachments, zoning issues, flood plain issues, etc., our firm will work with all parties to resolve them prior to closing. To learn more about our title examination process and work, contact our real estate law office today.
Misplaced right of way got you down? Improperly recorded deed? With compromise, coordination, and attention to detail, there is a solution to every problem. Where issues arise, we work in close coordination with the agents, lenders, and parties to resolve even the most complex of title questions.
Drafting Contracts & Easements
When working with a real estate agent, they will typically work with the other party’s agent to draft a purchase agreement or contract that all parties can agree upon. However, if you’re buying or selling a home without representation from a broker, or need the terms of a contract looked over, we are here to help. Conservation Easements
Life in Western North Carolina would be vastly different without its many national parks and environmentally protected lands that allow for our beloved, scenic mountain views. As such, we believe that environmental land conservation remains at the heart of life in Western North Carolina, for those of us lucky enough to call this area home. At Van Marter Law, we are passionate about the legal work necessary for protecting our natural environment.
On occasion, our firm advises clients on how to use conservation easements to safeguard environmentally sensitive properties. Whether as a part of a large land purchase, in support of a new development, or as a part of your estate planning, our firm will work closely with our clients’ team of advisors to find a clear path for those considering conservation.
Water Rights & Resource Management
From drafting well and water rights agreements for our real estate clients to advising on FEMA flood plain regulations and attendant local zoning regulations, Van Marter Law places critical importance on our water resources. Katherine’s practice originated in south Louisiana, where she worked to preserve coastal communities and respond to unique water resource and disaster relief challenges. Our firm leverages this critical understanding of the unique challenges water and climate can present to find unique solutions for our clients here in North Carolina.
